Social Benefits in the Netherlands for DAFT Residence Permit Holders

What You Can (and Cannot) Claim

I’ve written in the past about work-life balance on DAFT, noting that those of us living under the Dutch American Friendship Treaty (DAFT) are not able to access many of the benefits and perks Dutch citizens and other residents get through their employers.


So let’s take a look at which social benefits DAFT residence permit holders in the Netherlands are allowed to take advantage of – and which ones can put our residence at risk.


What the IND (Dutch Immigration) Says About DAFT Residence Permits and Social Benefits in the Netherlands


As an active DAFT residence permit holder, when I login to the MijnIND immigration portal, this is exactly what it says about my residence permit (in April 2026):


Arbeid als zelfstandige. Arbeid in loondienst alleen toegestaan met TWV. Een beroep op algemene middelen kan gevolgen hebben voor het verblijfsrecht.


Translation:

Self-employed work. Salaried employment is only permitted with a work permit. Reliance on public funds may affect the right of residence.


You are only allowed to work in paid employment if your employer has a work permit (TWV) from UWV for you.


If you apply for social benefits, such as bijstand or Wajong, your residence permit may be revoked. An application for rent subsidy, health care subsidy, child care benefits or child benefits has no impact on your right of residence.

This information is straightforward:

  • DAFT is a residence permit for self-employed people.

  • We are not allowed to work in paid employment unless our employer has a work permit (TWV) from UWV.

  • Applying for some social benefits can negatively affect our right of residence, but applying for other benefits does not negatively affect our right of residence on DAFT.


Translation: A TWV (tewerkstellingsvergunning) is a work authorization that an employer must request from the UWV (Uitvoeringsinstituut Werknemersverzekeringen) to hire someone from outside the EU/EEA. The worker cannot apply for it themselves; it is employer‑specific and role‑specific.


If this all sounds like Greek - or, er, Dutch - to you, let's take a look at the different social benefits mentioned, to get a better understanding of what assistance might or might not be available.


Social Benefits DAFTers Cannot Use:

What are bijstand and Wajong?


Bijstand

What is bijstand?

Bijstand is the Netherlands' primary income-replacement assistance.

Applying for bijstand can put a DAFT residence permit at risk. https://ind.nl/en/benefits-from-public-funds

Nothing similar exists in the United States at a federal level, though some states have general social assistance.


Key Differences and similarities between bijstand and U.S. Welfare

  • Generosity: Bijstand is typically more comprehensive in providing a "social minimum" that covers a wider range of living expenses, whereas U.S. welfare benefits are often lower, stricter, and more time-limited.

  • Structure: Bijstand is nationally regulated but managed by the municipalities. U.S. benefits vary considerably, depending on the state.

  • In both the U.S. and the Netherlands, recipients of general assistance are required to have very limited assets such as savings, property, and vehicles.


Wajong

What is Wajong? Wajong benefit (Wet arbeidsongeschiktheidsvoorziening jonggehandicapten) is a disability benefit for young disabled people. It is somewhat similar to Social Security Disability (SSDI) in the United States.


Key differences from U.S. SSDI:

  • Age‑based eligibility

  • No work history required

  • Strict work‑capacity assessment by UWV

Wajong is explicitly listed by the IND as a benefit that can lead to loss of residence rights for non‑EU permit holders. https://ind.nl/en/benefits-from-public-funds

Social Benefits That Do Not Affect DAFT Holders' Residence

The text above also says, "An application for rent subsidy, health care subsidy, child care benefits or child benefits has no impact on your right of residence." So let's look more closely at each of those.

Rent Subsidy: Huurtoeslag

Huurtoeslag is a housing benefit designed to help with rent costs. The amount of huurtoeslag (housing benefit) in the Netherlands is not a fixed amount, but a tailored subsidy based on:

  • income

  • rent

  • household size

  • age

Healthcare Subsidy: Zorgtoeslag 

Zorgtoeslag helps offset the cost of mandatory Dutch health insurance and is conceptually similar (at a high level) to U.S. ACA premium subsidies.

For 2026, you may qualify if:

  • your annual income is €40,857 or less

  • If you have a benefit partner in 2026, your combined income may not be higher than €51,142.

Child Care Benefits: Kinderopvangtoeslag

Child Care Benefits, or kinderopvangtoeslag, are a subsidy to offset the cost of childcare. The amount of kinderopvangtoeslag varies depending on

  • Parents' income

  • Type of childcare

  • Number of hours used

Child Benefits: Kinderbijslag

Kinderbijslag applies to all children under 18.

  • There is no income threshold for parents.

  • Child benefits vary depending on the age of the child

  • Paid quarterly.

The Bottom Line for DAFT Residence Permit Holders

If you’re living in the Netherlands under DAFT:

  • Depending on your income and assets, you may qualify for toeslagen (subsidies) like rent, healthcare, childcare, and child benefits. There is no income threshold for child benefits.

  • Income‑replacement benefits like bijstand or Wajong can jeopardize your right to remain in the Netherlands.

  • When in doubt, always confirm with the IND or a qualified immigration advisor.


If you plan to use DAFT as a pathway to permanent residence, be mindful of minimum income requirements, which are assessed at the time of application and change over time.

 

Note: The Dutch American Friendship Treaty (DAFT) grants a residence permit for self‑employed U.S. citizens. Many people informally refer to it as the “DAFT visa,” but legally it is a residence permit, not a visa.
